Wicket Labs Inc. (“Wicket Labs”) has developed this Privacy Policy to help you understand how Wicket Labs collects, uses, and discloses your personal information, whether you are a visitor of the Wicket Labs website (a “Visitor”), located at https://www.wicketlabs.com/ (the “Website”), and/or a registered subscriber of the Wicket Scorecard (a “Registered Subscriber”). Collectively, the Website, Wicket Scorecard, and any other services provided by Wicket Labs are the “Services.”

This Privacy Policy does not apply to you if you are an end user or customer of a Registered SubscriberThe Registered Subscriber’s use of your personal information is governed by the Registered Subscriber’s own privacy policy and data collection practices.

By continuing to use the Services, you agree to this Privacy Policy and consent to the collection and use of your personal information as set forth in this Privacy Policy.

  1. WHAT TYPE OF INFORMATION DOES WICKET LABS COLLECT AND FOR WHAT PURPOSES?Wicket Labs collects the following types of personal information while you use the Services.
    1. Personal Information You Provide to Wicket Labs Directly. Wicket Labs collects the personal information that you directly provide to Wicket Labs, whether through the Website, via email, or via any other communication method.For example, if you are a Visitor and fill out and send the “Contact Us” form on the Website, Wicket Labs collects the personal information that you voluntarily provide in the form (e.g. your name and contact information) and uses this information to contact you. If you choose to opt-in, Wicket Labs will also use your email address to send you marketing newsletters and communications about the Services. You may unsubscribe from these marketing communications at any time by following the opt-out instructions in any one of these emails.In addition, to become a Registered Subscriber, Wicket Labs requires your personal contact information, such as your name, phone number, your company’s physical address, and email address. Wicket Labs uses this information to process your registration and login information for the Wicket Scorecard.
    2. Personal Information Collected Automatically. When you use the Website, there is certain information that Wicket Labs, or its Service Providers (as defined below), will automatically collect from the device (e.g. your smartphone, computer, or tablet) that you are using to visit the Website including, without limitation, your IP address and/or device ID, and “Log Information,” such as your browser type, operating system, referral and exit pages, and your access times. Depending on the country you are from, this information may be considered as “personal information.” Wicket Labs and its Service Providers use cookies and log files to automatically collect this information. For more information on our use of cookies, please refer to Section 3.
  2. THIRD PARTIES AND YOUR PERSONAL INFORMATION.
    1. Service Providers. Like many companies, Wicket Labs uses tools from service providers to help Wicket Labs operate the Services (“Service Providers”), and depending on the service, these Service Providers may have access to your personal information. Although Wicket Labs contractually requires all Service Providers to use your information in connection with the requested services and to treat your information as confidential, Wicket Labs does not control Service Providers’ actual use of your information and Wicket Labs is not responsible for Service Providers’ use of your information for purposes not authorized by Wicket Labs.
    2. Business Transfers. As Wicket Labs continue to develop its business, Wicket Labs may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third-parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of its assets are acquired or Wicket Labs merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that Wicket Labs reserve the right to transfer any information collected from you in the case of any such transfer. In such event, Wicket Labs will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.
    3. Legal. Wicket Labs may disclose information you provide to respond to subpoenas, court orders, requests from authorities, and other legal processes, and to establish/exercise its legal rights. Wicket Labs may also disclose your information to defend against legal claims when Wicket Labs believe that disclosure is necessary to protect its rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. Wicket Labs may share your information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person or as otherwise required by law.
  3. COOKIES.
    1. What are Cookies? A cookie is a small text file that is stored on your computer by a website you visit. Most commonly, websites use cookies to identify visitors, remember visitors’ preferences, and to keep visitors logged into their accounts while they navigate the website. Cookies are either first-party cookies, which belong to the domain you are visiting, or third-party cookies, which are set by and belong to a different domain than the one that you’re currently visiting.
    2. What Kind of Cookies are Used on the Website? Wicket Labs uses first-party cookies that are essential to operating the Website. For example, if you are a Registered Subscriber, Wicket Labs will use cookies to identify and remember you while you are logged into your Wicket Scorecard account. In addition, the Website uses the third-party cookies found in our cookie policy.
  4. THIRD-PARTY LINKS AND SERVICES.The Website may contain links to third-party websites, services, or applications. If you choose to visit these third-party links, the use of your information will be governed by such third party’s privacy policy. Please review that third party’s privacy policy to learn how your personal information will be collected and used by that third party.
  5. SECURITY.The security of your information is important to Wicket Labs. Wicket Labs follows generally accepted industry standards to protect your information, both during transmission and once it receives your information. However, no method of transmission or storage is 100% secure, and Wicket Labs cannot guarantee your personal Information’s absolute security.
  6. STORAGE AND RETENTION.Personal information that Wicket Labs collects under this Privacy Policy is transferred to and stored on the servers of Wicket Labs’ cloud-based data hosting Service Providers, which may be located in the United States. How long Wicket Labs retains your personal information will depend on the purpose for which it collected the information.
  7. ACCESS TO YOUR DATA; EU DATA RIGHTS.If you wish to correct your personal information or have access to the personal information that Wicket Labs may have about you, please contact Wicket Labs at contactus@wicketlabs.com.If you are from a country in the European Union, you additionally have the right to request Wicket Labs to perform the following in accordance with the General Data Protection Regulation (“GDPR”): to correct your personal information if the information that Wicket Labs has is inaccurate; subject to a few exceptions, to delete your personal information or restrict further use of your personal information; and to provide a copy of all of the personal information that Wicket Labs holds about you in a machine-readable format. In addition, in some countries, you have the right to file a complaint with the appropriate data protection authority if you have concerns about how Wicket Labs uses your personal data.
  8. CHANGES TO THIS PRIVACY POLICY.Wicket Labs reserves the right to change the terms, conditions, and notices under which the Services are offered, including but not limited to the charges associated with the use of the Services and the personal information. When Wicket Labs does, Wicket Labs will update the revision date at the top of this Privacy Policy. Your continued use of the Services indicates your agreement to the modified terms, conditions and notices.
